Trubuddyy Solutions Private Limited including its subsidiaries, affiliates, associate/group companies and licensors (hereinafter referred to as “Trubuddyy”, “Company”, “we”, or “our” or “us”) welcomes you, irrespective of whether you are a mere visitor or a Mentor, Mentee, beneficiary (the “Customer”, “Subscriber”, “User”, “you” or “your”) to our website [https://trubuddyy.com] (“Website”).

We take your privacy and data protection very seriously. This Privacy Policy, describes how Trubuddyy collects, uses, shares, protects and processes your personal information obtained from our Website. The personal data collected by us shall be processed and stored within the territory of India. The Services are governed by this Privacy Policy, Terms, and any other rules, policies or guidelines published on the Website (as applicable to you). If any information provided by you or uploaded by you on the Website violates the Website Terms, Trubuddyy may delete such information or revoke your access to the Website or take any other action as it deems fit.

Capitalised terms used but not defined herein shall have the meaning ascribed to them in the Terms.

SCOPE AND APPLICABILITY OF THIS PRIVACY POLICY:

This Privacy Policy applies and extends to all users of the Website, including without limitation, (i) visitors of the Website, (ii) the Mentors, (iii) the Mentees, and (iv) third party licensors. This policy applies to Trubuddyy’s contents, products, Services and Website.

PERSONAL INFORMATION WE COLLECT

It is to be noted that specific data is gathered in an automated manner upon your visit, utilisation or navigation of the Website. It may encompass device and usage data, including but not limited to your IP address, browser and device attributes, and other particulars regarding your usage of our Website, and other technical data. The aforementioned information is deemed essential for the preservation of the security and functionality of our Website. 

The Information that we may gather during your usage of our Website is as follows:

  1. Contact details, including but not limited to the first and last name, residential address, mobile number, title or designation, religion, date of birth, gender, qualifications, name of the organisation (if applicable), email address and any other basic details as may be required by Trubuddyy.
  2. Authentication Credentials, which grants access to user accounts and biometric data (photograph), through any channels including third-party service providers.
  3. Communications, conducted with you, including but not limited to the instances when you contact us via our Website or any other means. Further, your responses to assessments like quizzes, document submissions, feedbacks, queries, telephonic conversations with Trubuddyy, simulation games, brand stories and any such assessment for any opportunity or suggestion;
  4. Images / videos, which are being uploaded by you or liked by you while accessing our Website. 
  5. Payment information would be required by our payment partner to complete your transactions to use our Services, including the user’s name, payment card information, and billing information. 
  6. Marketing information, such as your preferences and consents for receiving our marketing communications.
  7. Tracking information, such as, but not limited to the IP address of your device and device ID when connected to the internet (including the operating system), your browser information, time zone setting and location, internet service provider, type of camera, microphone or speakers and other information associated with your interaction with the Website such as details of your Website usage for analytics, your browsing behaviour and the pages you visit;
  8. Information related to the browser or device you use to access our Website; and
  9. All other data not explicitly enumerated herein shall be utilised in accordance with the provisions set forth in this Privacy Policy or as otherwise revealed during the data collection process.

The information that we obtain from third parties:

  1. We may collect your information from your interaction with our social media pages including but not limited to Instagram, Facebook, LinkedIn, Twitter, Pinterest, WhatsApp and YouTube.
  2. We may collect your information when you link or connect or login through third party service providers including but not limited to Google, Facebook and Apple.

We might also gather certain data automatically, provided as follows:

  1. Usage Information – Information relating to but not limited to, how much you use our Website, the amount of time you spend on it, etc; and
  2. Camera, photos, and video – this information is collected because many services on our Website require us to collect images and videos and other information from your device’s camera and photos.

Trubuddyy may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our search technology, customized content and advertising.

In addition, when you use Trubuddyy, you may make some of your personal information public. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return and Trubuddyy will not be responsible for the use or misuse of such information.              COOKIES 

The Website uses data collection devices such as “cookies” on certain pages of the Website to analyse our web page flow, measure promotional effectiveness and promote trust and safety. Cookies are small files placed on your hard drive that assist us in providing the best of our Services to you. These cookies do not contain any personal information of the user. Cookies help us to provide information to you that is targeted to your interests. You are always free to decline/delete our cookies if your browser permits, although in that case, we may not be able to provide you with the best of our Services. We also use various third-party cookies for usage, behavioural, analytics and preferences data. Trubuddyy ensures that all information collected and accessed by Trubuddyy through the access of these cookies will be maintained in accordance with this Privacy Policy.

WITHDRAWING CONSENT

Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes, such as those set out above. In some cases, we are able to send you direct marketing without your consent, where we rely on our legitimate interests. You have an absolute right to opt-out of direct marketing, or profiling we carry out for direct marketing, at any time. HOW DO WE USE YOUR INFORMATION? 

We put the data we acquire from our Website to several different types of business purposes mentioned below. These uses of your personal information are based on our legitimate business interests, your permission, our contractual responsibilities, and/or our legal requirements. We use personal information obtained through the utilisation of our Website for an array of business objectives as delineated hereunder:

  3. password reminders and registration confirmation;

  3. communicate with you about the Services, including but not limited to sending announcements, updates, security updates and support and administrative messages;

  6. for marketing purposes;
  7. for complying with the Applicable Laws as well as meeting the Know-Your-Customer (KYC) requirements as mandated by the regulatory bodies;

  9. for any requirement as made by the law and which makes such disclosure necessary to respond to subpoenas, court orders, or other legal process;
  10. for the resolution of disputes or grievance redressal; and

We do not accept any responsibility or liability for usage of your personal information by these third parties or their policies.

Email communication that you send us via the email links on the Website may be shared with company representatives, partners or employees. From time to time, we may send you service-related emails, such as a welcome email when you come in touch with the Website.

INFORMATION SHARED BY MENTEE DIRECTLY WITH THE MENTOR:

The Mentor may request for certain information of the Mentee during any event, counselling, session, interview, discussion or any such interaction organized by Trubuddyy which is in addition to the information obtained by the Website. Such information shared by Mentees with Mentors may include certain special categories of information such as data revealing, racial or ethnic origin, political opinions, religious or philosophical beliefs, career choices, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a person, data concerning health or data concerning a person’s sex life or sexual orientation. Please note that any such information shared by the Mentees with the Mentors is being provided directly by Mentees to Mentors and Trubuddyy is in no manner involved in such sharing of information. Trubuddyy shall in no manner be responsible and/or liable for the use, misuse, or treatment of such information and this Privacy Policy does not govern any such information shared by the Mentee with the Mentors.

HOW DO WE KEEP YOUR INFORMATION SAFE? 

We use rational and appropriate organisational, technical, and administrative measures that are specifically devised to safeguard against any unauthorised access, misuse, loss, disclosure, alteration, or destruction of the personal information that we maintain. It is regrettable to inform that the security of data transmission over the Internet cannot be guaranteed in its entirety. Whereas our utmost endeavour is to safeguard your personal information, we are unable to provide a guarantee of the security of said personal information.

YOUR RIGHTS:

You have access to the Personal Data and you have a right to update your information to correct, up-to-date, and complete the information provided by you. Please get in touch with us as described below, and we will take reasonable measures to update, restrict, delete or rectify information in our possession that you have submitted via the services in the past.  

In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement, or where we are using the data for direct marketing).

All the users of our Website are provided with an opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us after setting up an account on the Website. If you do not wish to receive the promotional communications from us, then please unsubscribe by clicking on the unsubscribe link in the email.

Where the processing of your Personal Data is based on your consent, you have the right to withdraw your consent at any point in time in accordance with this Privacy Policy. Please note that should the withdrawal of consent result in us not being able to continue offering our Services to you, we reserve the right to withdraw or cease from offering our Services to you upon your consent withdrawal. You may withdraw consent by contacting us with a written request to the contact details provided in the 'Grievances' section below. Upon receipt of your request to withdraw your consent, the consequences of withdrawal may be communicated to you. Upon your agreement to the same, your request for withdrawal will be processed.

Kindly note that, you are entitled to exercise your rights as stated above only with respect to your information, including Personal Data, and not that of other users. Further, when we receive any requests or queries over email or physically to the address specified in the 'Grievances' section below, then, as per the Applicable Laws, we may need to ask you a few additional information to verify your identity in association with the Website and the request received.

USAGE BY MINOR INFORMATION 

We do not render our Services for use by children under 18 (eighteen) years of age. If you are under the age of 18 (eighteen) years, you shall use the Services of the Website with the involvement of a parent or guardian. We do not knowingly solicit or collect personal information from minors under the age of 18 years.

DATA RETENTION 

We generally retain your personal data as long as you keep your account open or as needed to provide you Services and for a period of [1] years after you have requested that your account is closed or if it’s been inactive for [2] years. We might retain your information for an extended period of time as allowed by Applicable Laws if:

  1. there is any legal obligation to retain the data;
  2. there is any statutory or regulatory retention requirement by law; and
  3. if we believe it may be necessary to prevent fraud or future abuse.

SECURITY

Your Trubuddyy account information is password-protected for your privacy and security.

CHANGES TO THIS PRIVACY POLICY 

We request you to check our Privacy Policy periodically for changes. We may update our policy to reflect material changes to our information practices. We shall intimate you with any changes to the Privacy Policy by an email notification when we are required to do so by Applicable Law. 

AFFILIATES AND SUBSIDIARIES: 

We may disclose information about you to our affiliates, subsidiaries and other businesses under the same control and ownership, and their respective officers, directors, employees, accountants, attorneys, or agents, who need the information to help us provide the Services or process the information on our behalf or as stated in our Terms. We require our affiliate, subsidiaries and other businesses under the same control and ownership to follow this Privacy Policy for any Personal Data that we share with them.

GRIEVANCES:

If you have any questions about this Privacy Policy, wish to exercise your rights, or have concerns about privacy of your data or any privacy related grievances , please register your complaint with a thorough description via email to [support@trubuddyy.com] 

ACCOUNT DELETION:

If you wish to delete your account (as Mentor or Mentee) you can email us at [support@gmail.com] from your registered email.

CANCELLATION POLICY:

If Mentor Cancels - 

Full amount is transferred back to the customer/mentee.

If Mentee Cancels -

             No refund is applicable. 

             REFUND POLICY:

Please note that the following policy applies exclusively to individuals registered as mentees on the Trubuddyy platform.

A mentee may contact us at support@trubuddyy.com if they anticipate a refund on funds added to their wallet, but only if one of the following scenarios arises after a thorough review by our team: 

  1. •The Mentor cancels an approved session after call details have been shared with both parties and the mentee is not keen to use the paid-up amount against any future mentor sessions with the same or any other mentor on the platform.
  2. •The Mentor does not show up for an approved session after call details have been shared with both parties and the mentee is not keen to use the paid-up amount against any future mentor sessions with the same or any other mentor on the platform.
  3. •The Mentor reschedules an approved session to a different slot that does not work for a Mentee and the Mentee does not want to use the paid-up amount against any future mentor sessions with the same or different mentor on the platform. 
  4. •We are unable to get a response from a mentor on a call request shared by a mentee for more than 1 month since the time the request was sent by a mentee to the said mentor
  5. •A call request by a mentee gets rejected by the mentor

Our refund policy does NOT include a refund in the following cases- 

  1. •Mentee does not show up for a mentoring session 
  2. •Mentee cancels a mentoring session
  3. •Mentee reschedules a mentoring session 
  4. •Mentee does not believe he/she has learned from the session
  5. •Mentee feels that the mentoring session did not work for him/her 
  6. •Mentee added money to the wallet, forgot to book a session, and is now expecting a refund
  7. •Mentee sends a request to a mentor and then has a change of heart before the mentor responds to the request
  8. There is no particular reason for requesting a refund

We enforce this policy rigorously as these payments support our mentors, many of whom dedicate a significant portion of their spare time to mentoring for modest compensation. Additionally, a portion of these payments is allocated to developing consistent career readiness and mentoring materials for our mentees' benefit.
